  5. "Bad Example Shareware Technologies of California, Inc [hereinafter known as
  6. VENDOR] warrants the media upon which your software is copied.  You
  7. [hereinafter known as CONSUMER] have certain legal rights.  In the rare event
  8. that you should receive a disk which is unreadable, simply return it within 30
  9. days, postpaid, along with a stamped self addressed mailer and a notarized
  10. photocopy of your reciept, to: Customer Returns Dept, B.E.S.T., 10421 Barker
  11. Blvd Ste 4-H, Mammoth Takes, CA 93546.  No RMA is necessary.  VENDOR will issue
  12. a duplicate copy of the defective software.

  14. "Furthermore, VENDOR warrants the copied software to run on CUSTOMER's IBM(sm)
  15. personal computer, or compatible.  Should your computer be unable to run the
  16. copied software, then you may return your computer to: Incompatible Compatible
  17. Returns Dept, Imperial Behemoth Machinations, Amock, NY 10504-9842.

  19. "Due to factors beyond our control, VENDOR does not warrant the software.  In
  20. no event will VENDOR be responsible for the software, its performance or lack
  21. of performance to your expectations, nor for damages to your hardware, other
  22. software, data, sanity, or business reputation.  In no event will VENDOR be
  23. liable for loss of business, loss of business profits, loss of business
  24. opportunity, loss of business profit opportunity, or loss of business
  25. opportunistic profits, as a direct consequence of, or as an indirect
  26. consequence of, the use or the misuse of said copied software.

  28. "In no event will VENDOR's liability exceed the copying fee for the copied
  29. software, and in all events and circumstances, VENDOR's entire libality shall
  30. be extinguished upon refund of CONSUMER'S copying fee.

  32. "The venue of all legal claims against VENDOR shall be the State of Alaska, or
  33. the Territoy of the US Virgin Islands, or Guam, whichever is further from
  34. CONSUMER's residence or place of business."
